3. Assessment 2 (Re-submission) Details

3.1 Task
Farage and his partner, Celes, have recently separated; they were not married. Farage is seeking
advice on the following matter. In 2010, Farage decided to buy a house. Originally, Farage and Celes
planned to buy the house in joint names, but the mortgage lender would not accept Celes as a party to
the mortgage, because she had a poor credit score.
They decided that the house would have to be purchased in Farage’s sole name, but he said that he
would always treat it as Celes’ home as well. The purchase price was £200,000. Farage provided a
deposit of £10,000. The mortgage loan covered the rest of the price. Celes paid for some furniture from
her savings. Farage and Celes have lived there ever since. Farage paid the monthly mortgage
repayments.
They opened a joint account, into which they both paid a monthly sum; Farage contributed £700 every
month and Celes paid in £1,000 a month. The regular household outgoings have been paid by direct
debit out of the joint account. The house is still registered in Farage’s sole name and he claims that
Celes has no interest in the house. Celes maintains that she has a half-share.

Task
Advise Celes on what grounds she could claim a half–share in the house and whether she is
likely to be successful under the rules of implied trusts (examining both resulting and
constructive trusts rules) and if any remedies may be available to her. Support all discussions
with relevant authorities.
3.2 Submission requirements
